A sentencing hearing for Corey Lyons — convicted of shooting to death his brother Daniel Lyons and Daniel’s partner, Barbara Scharton, in their home in May 2009 — was delayed until April. It is anticipated that Bob Sanger, defense attorney for Lyons, will file a motion for a new trial. Should Judge Brian Hill deny the motion, Lyons will be sentenced to life in prison without parole. He was convicted after a third trial — the first two ended in mistrials, one because of a hung jury, the other because of an improper statement from a witness.

Prima facie jury misconduct. A new trial is a slam-dunk...and should Hill deny it, he'll be reversed on appeal.
